Welcome to Pam's Pages. By accessing or using the website, directory, and internal messaging features (collectively, the "Service"), users agree to be bound by these Terms of Service and Privacy Policy. The Service is owned and operated by PeopleArtMusic LLC. If a user does not agree to these terms, use of the Service is prohibited.
Terms of Service
1. Purpose of the Platform
Pam's Pages is an online neighborhood directory and community bulletin board built to connect independent creators, local businesses, organizers, and neighbors. The Service provides a platform for users to discover talent, list services, share local opportunities, and communicate internally.
2. Intermediary Status & Application Approval (The "User Risk" Rule)
- Curation & Approval: Pam's Pages reviews and approves applications to join the network in an effort to maintain a trusted, high-quality community directory.
- No Endorsement or Guarantee: While an application process is in place, approval does not constitute an official endorsement, background check, or legal guarantee of a user's character, safety, professionalism, or the quality of their work.
- No Liability for Transactions: Any agreements, contracts, gigs, hires, or exchanges of money made between users are strictly between those individuals or businesses. Pam's Pages is not a party to any transactions and is completely exempt from any liability, disputes, damages, or losses resulting from user interactions.
3. User Accounts & Content Rules
- Eligibility: Users must be at least 18 years old to create an account.
- Prohibited Content: Users retain ownership of the text and images uploaded, but agree not to post anything that is fraudulent, defamatory, discriminatory, obscene, or infringing upon copyright or trademark laws.
- Account Safety: Users are responsible for keeping account login information secure. Users agree not to use the internal messaging system to spam, harass, or scam other neighbors.
4. Future Payments & Third-Party Processors
If a user purchases a subscription or feature on the platform in the future, all financial transactions will be handled securely off-site through a dedicated, PCI-compliant third-party payment processor (such as Stripe). Pam's Pages does not collect, process, or store credit card numbers or financial account routing data on its servers.
5. Disclaimer of Warranties ("AS IS" Clause)
PAM'S PAGES IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEOPLEARTMUSIC LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. THERE IS NO GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. USE OF THE SERVICE, AND INTERACTIONS WITH OTHER USERS FOUND THROUGH THE SERVICE, IS ENTIRELY AT THE USER'S OWN RISK.
6. Limitation of Liability
IN NO EVENT SHALL PEOPLEARTMUSIC LLC, ITS OFFICERS, OR ITS EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO USE OF THE SERVICE, USER CONTENT, OR THE CONDUCT OF ANY THIRD PARTY ON THE SITE.
7. Mandatory Dispute Resolution & Class Action Waiver (Arbitration Clause)
PLEASE READ THIS SECTION CAREFULLY, AS IT AFFECTS YOUR LEGAL RIGHTS.
- Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to the Service, these Terms, or user interactions shall be settled by final, binding arbitration administered by a recognized private arbitration service (such as JAMS or the American Arbitration Association), rather than in a court of law.
- Waiver of Class Actions: All claims must be brought in the user's individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
- Location: The arbitration shall take place individually in San Francisco, California.
8. DMCA Copyright Takedown Policy
Pam's Pages respects copyright law and expects users to do the same. If a copyright owner believes that any content hosted on Pam's Pages infringes upon a copyright owned or controlled, immediate notification should be sent to the Designated Copyright Agent with the following information:
